Introduction

Any use of the Baiser Salé ticketing website, https://lebaisersale.pixeine.fr, by the customer implies unreserved acceptance of the general terms and conditions of sale. These terms and conditions are subject to change without notice.

Article I. Online purchase

Ticket prices are quoted in euros, inclusive of all taxes (including rental costs, but excluding ticket processing and issuing costs). The Subscriber price is exclusively reserved for holders of the Subscriber card. All purchasers of season tickets must be able to show their valid personal card at the entrance to the club. The pre-sale ticket purchase offered on the online sales site https://lebaisersale.pixeine.fr closes one hour before the start of the event. The purchaser is informed, in real time, when the order is placed, of the availability of the seats required. Each ticket on sale constitutes a dematerialised right of entry (electronic ticket).

For all purchases on the online sales site https://lebaisersale.pixeine.fr, the tickets are instantly sent by email to the buyer once payment has been confirmed. As proof of purchase, they are either printed out by the purchaser or downloaded onto a mobile phone that can be displayed on screen. As a result, the purchaser must present the ticket or tickets printed out by him or her or downloaded onto his or her mobile phone at the Baiser Salé entrance. For all purchases at Baiser Salé, 58 Rue des Lombards - 75001 Paris, France, proof of purchase will be given to the purchaser in person. Printed or downloaded tickets will be checked by bar code readers when entering the event for which they are valid.

In the case of tickets printed by the purchaser, the information on the ticket must be clearly legible. Illegible, damaged, soiled or incompletely printed tickets will not be accepted and will not be valid. The purchaser must also ensure that the information is correctly displayed and legible on his/her mobile phone.

A ticket is only valid for the event to which it entitles the holder. This information is mentioned on the ticket: the name of the show, the venue, the date of the event and the time of the event.

Tickets cannot be exchanged or refunded, even if lost or stolen. No duplicates will be issued and resale is prohibited. Promotional codes, membership discounts, under-26 rates and promotional offers cannot be combined. It is strictly forbidden to counterfeit, duplicate or reproduce an electronic ticket. The reproduction and use of a copy of this ticket are liable to prosecution.

Article II. Season ticket

The subscriber card gives access to the subscriber rate and other offers intended for our members. Unless otherwise stated, the card is valid from date to date on the subscription date. Under no circumstances will it give additional time in the event of a pandemic, health or natural disaster, etc.

Article III. Confidentiality

The personal data collected as part of the services offered on https://lebaisersale.pixeine.fr are processed using secure protocols and enable SARL Le Baiser Salé to manage the services offered to you via this IT platform. For any information or in order to exercise your various rights (access, rectification, omission, limitation, portability, opposition, etc.) concerning the processing of your personal data managed by SARL Le Baiser Salé, you may contact the data controller:

Purchase process and collection of personal data

The platform may collect various personal data in order to enable us to provide the service(s) requested. This data may be collected either via a series of forms filled in directly by you during "online" transactions, or by a ticketing operator based on the information you provide.

Membership card

When you create your subscriber card, you give your consent to the collection and processing of the information requested: surname, first name, e-mail address, gender, address, postcode, town, telephone number, date of birth. This information is collected in accordance with our legitimate interests so that we can create and manage your subscription card, obtain statistical information on our subscribers and, where applicable, be subject to automated processing or profiling as part of our marketing policy and in order to provide you with additional services or offers (invitations, mailing of documents). If you do not provide the mandatory data, we will not be able to provide you with the services we offer and you will not be authorised to create a subscription.

Purchase procedure: customer account

In order to make your purchase, particularly online, you have the choice of a single procedure. Creating an account enables you to finalise your purchase by creating a reusable CUSTOMER ACCOUNT which will then enable you to identify yourself via your e-mail address and a personal password in order to finalise your subsequent transactions but also to update your personal data, find your various transactions and invoices or proof of payment. The creation of a customer account implies your consent to the collection and processing of the information requested: surname, first name, e-mail address, postcode, town, telephone number, title and musical style. This information is collected in accordance with our legitimate interests so that we can create and manage your customer account, obtain statistical information on our customers and, where appropriate, be subject to automated processing or profiling as part of our marketing policy and in order to provide you with additional services or offers. If you do not provide this mandatory data, we will not be able to provide you with this service and you will not be authorised to create a customer account on our platform. You may also exercise your right to object, free of charge and at any time, by contacting us at the address given in the preamble to our PRIVACY POLICY.

Nominative tickets

Some tickets may be nominative. By providing this information (surname and first name of the holder), you agree that it may only be used for control purposes at the entrance to the event concerned.

Mailing lists

Our ticketing platform collects personal information for use in the following mailing lists:

• "General Newsletter": an electronic newsletter designed to keep you informed about concert events and activities offered by our venue.
• "Subscriber Card Newsletter": an electronic newsletter designed to inform subscribers about offers available to them.

By ticking the corresponding box(es) on our various forms, you give your consent to be contacted by the corresponding department. Each mailing contains an http link allowing you to unsubscribe at any time. Our mailing lists are managed directly by our platform.

Use of data collected outside our platform

The data collected by our platform is under no circumstances passed on or sold to third parties. It may, however, and where appropriate, be used and transferred to third-party applications for various processing purposes:

• For processing the bank transaction, during the online purchase
  When you purchase online by credit card, the data required to process your order (surname, first name, e-mail) is sent securely to the BILLETWEB banking platform responsible for this processing. No banking data is collected or stored on our platform during this procedure.
• As part of the routing of transactional emails
  In order to optimise the deliverability of our transactional emails (sending of tickets and subscriptions, confirmation of account creation, etc.) and using the email routing platform.
• As part of the operation of mailing lists
  In order to use and manage (unsubscribe) mailing lists, and to route the information concerned.
• For ticket control operations
  In the case of partnerships with other venues or producers and where tickets sold on our platform are checked by another system.
• As part of analyses or studies of our sales, customers and subscribers
• As part of our marketing policy and business management.
  We may carry out automated processing (profiling) or semi-automated processing (querying) of the data collected for the purposes of statistical studies, monitoring sales, sending information or commercial offers on our activities. Retention period

We will keep your personal information on our systems for as long as is necessary for the activity concerned, unless you request that your account be closed or you exercise your right to be forgotten, and in compliance with and within the limits of the legal obligations to keep documents relating to our commercial activity.

Article V. Indirect data collection

Our platform may also collect and process personal data provided by third parties. This only concerns ticketing data supplied by distributors who also sell tickets for our events: DISPOBILLET, BILLETREDUC, DIGITICK... The processing of this data only concerns the ticket control procedures carried out at the entrance to the event.

Article VI. Online payment

Your payment can be made using the following credit cards:

• Premier card
• Foreign VISA cards bearing the VISA three-colour banner (blue, white, ochre) and the hologram dove on the right,
• EuroCard/MasterCard cards identified by their "MC" hologram.

All payments made from the https://lebaisersale.pixeine.fr site are made exclusively by bank card after acceptance by the purchaser of these general terms and conditions of sale. Online payment is made using the BILLETWEB and 3D Secure secure interface depending on the amount in your Shopping Basket. Only the acceptance of the payment by BILLETWEB validates the sale and results in the issue of the tickets and or subscriber number. The personal and confidential data collected during transactions is exclusively intended for the management of ticketing and subscriber files and is at no time intended to be sold, marketed or leased to a third party.

Article VII. Cancellation and modification by the customer

No reimbursement will be made for any service not used for whatever reason. In all cases, cancellations of bookings for shows will incur a cancellation fee of 10% of the cost of the performance, with a minimum of 10 euros, provided that you are notified by e-mail one week before the date of the concert ordered. Lastly, cancellations of bookings for shows after this period will incur cancellation fees corresponding to 100% of the performance and may not give rise to any reimbursement. Cancellations of purchases of products from our shop will also incur bank charges. Refunds may be made with a deduction of 10 euros. Concerts cancelled by us or by the productions representing these musicians will be reimbursed in full. However, we are not responsible for changes in the composition of the groups. If a performance is interrupted for more than one hour, tickets cannot be exchanged or refunded.

In the event of an administrative closure resulting from a decision beyond our control (pandemic, natural disaster, war, industrial action, etc.), cancelled concerts will not be eligible for a refund. We will offer our customers in possession of a concert ticket purchased on our website a credit note valid for one year or a postponement until the next date of the chosen concert.

Article VIII. Intellectual property rights

All documents, information, texts, graphics, images, photographs or any other content published on the site are protected by copyright and intellectual property laws throughout the world. Consequently, and in accordance with the French Intellectual Property Code, only use for private purposes is authorised, subject to more restrictive legal or regulatory provisions. Any other use is likely to be qualified as counterfeiting and sanctioned by the competent French courts, except with the express prior written authorisation of https://lebaisersale.pixeine.fr. Consequently, any reproduction, alteration or modification of any element of the site is prohibited.

Applicable law - Disputes

Sales of tickets and season tickets made on the https://lebaisersale.pixeine.fr site are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
